PURPOSE OF THE AGREEMENT<\/strong><\/h3>\n\n\n\n<p>The Agency acts as an intermediary to present candidates (household staff, high-end childcare providers, etc.) to the Client. <strong>The Agency does not employ any candidate directly<\/strong>: the Client hires the Candidate under their own contract, or as an independent contractor if applicable.<br><strong>The Client and the Candidate undertake to inform the Agency of any effective hiring within two months of the presentation.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. FEES AND PAYMENT TERMS<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Fees<\/strong>: Calculated as a percentage of the Candidate\u2019s annual net salary (see rate schedule below).<\/li>\n\n\n\n<li><strong>Billing<\/strong>:\n<ul class=\"wp-block-list\">\n<li>One contract = one invoice. For a rota of two nannies, two contracts and two invoices will be issued.<\/li>\n\n\n\n<li>If a temporary contract is converted to a permanent one, an adjustment will be billed to cover the difference.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Payment<\/strong>:\n<ul class=\"wp-block-list\">\n<li>Fees must be paid within <strong>5 days of invoicing<\/strong> and <strong>before the Candidate starts<\/strong>.<\/li>\n\n\n\n<li>Late payment may result in the cancellation of the placement and forfeit the right to replacement or refund.<\/li>\n\n\n\n<li>For temporary placements, fees are due upon confirmation and signature by the Client and the Candidate, even if the start date is delayed.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Paid Reservation (Exclusively for Maternity Nurses)<\/strong>:\n<ul class=\"wp-block-list\">\n<li>If the waiting period exceeds 4 weeks, a paid reservation will be required:\n<ul class=\"wp-block-list\">\n<li>Compensation for the Candidate (to be negotiated directly with them).<\/li>\n\n\n\n<li>Compensation for the Agency (to secure the selected Candidate).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>A Candidate secured by a signed contract cannot be assigned to another Client, even in the event of an early birth.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3. EXPENSES AND RESPONSIBILITIES<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Client\u2019s Responsibilities<\/strong>:\n<ul class=\"wp-block-list\">\n<li>Travel expenses for the Candidate (interviews, start of employment, return).<\/li>\n\n\n\n<li>Accommodation and meals for the Candidate during the assignment.<\/li>\n\n\n\n<li>All administrative formalities (immigration, employment contract, medical coverage, etc.).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. CANCELLATION<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the Client cancels after the invoice is issued, <strong>80% of the fees remain due<\/strong>.<\/li>\n\n\n\n<li>If cancellation occurs <strong>less than 4 weeks before the start date<\/strong>, the full invoice remains due.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5. TRIAL PERIOD AND REPLACEMENT<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Trial Period<\/strong>: 2 months.<\/li>\n\n\n\n<li>In the event of termination during this period:\n<ul class=\"wp-block-list\">\n<li>The Agency will seek a replacement (maximum 2 attempts).<\/li>\n\n\n\n<li><strong>Refunds will only be granted if<\/strong>:\n<ul class=\"wp-block-list\">\n<li>The Candidate fails to appear without valid reason.<\/li>\n\n\n\n<li>The Agency cannot find a replacement within 2 months of the withdrawal.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>No refund will be granted if<\/strong>:\n<ul class=\"wp-block-list\">\n<li>The Client refuses a substitute Candidate proposed by the Agency.<\/li>\n\n\n\n<li>The actual employment or accommodation conditions do not match those communicated to the Agency.<\/li>\n\n\n\n<li>The termination is due to personal reasons (illness, death, accident, etc.).<\/li>\n\n\n\n<li>The Client does not wish for a replacement.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Refund Request<\/strong>: Must be submitted in writing to the Agency within 5 days, with justification.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>6. GENERAL PROVISIONS<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Start of Employment<\/strong>: Subject to prior payment of fees.<\/li>\n\n\n\n<li><strong>&#8220;Open&#8221; Package<\/strong>: Option allowing the Client access to an unlimited number of candidates (see package below).<\/li>\n\n\n\n<li><strong>Confidentiality<\/strong>: All information relating to Candidates is strictly confidential.<\/li>\n\n\n\n<li><strong>Governing Law<\/strong>: This Agreement is governed by French law.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>7. CANDIDATE OBLIGATIONS<\/strong> <em>(for reference)<\/em><\/h3>\n\n\n\n<p>The Candidate undertakes to:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Comply with the terms of the employment contract<\/strong> concluded with the Client, including:\n<ul class=\"wp-block-list\">\n<li>Agreed working hours, tasks, and conditions.<\/li>\n\n\n\n<li>Confidentiality rules regarding the Client\u2019s private life and property.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Inform the Agency and the Client promptly<\/strong> in case of:\n<ul class=\"wp-block-list\">\n<li>Changes in circumstances (e.g., unavailability, health issues, etc.).<\/li>\n\n\n\n<li>Difficulties fulfilling obligations (e.g., non-compliant working or accommodation conditions).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Comply with applicable laws<\/strong>:\n<ul class=\"wp-block-list\">\n<li>Adhere to local regulations (e.g., labor laws, immigration if applicable).<\/li>\n\n\n\n<li>Provide all necessary administrative documents (e.g., visa, employment contract, certifications).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Fulfill professional responsibilities<\/strong>:\n<ul class=\"wp-block-list\">\n<li>Perform duties with diligence and professionalism.<\/li>\n\n\n\n<li>Refrain from disclosing confidential information about the Client or the Agency to third parties.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Participate in interviews and procedures<\/strong>:\n<ul class=\"wp-block-list\">\n<li>Be available for interviews with the Client and the Agency.<\/li>\n\n\n\n<li>Provide accurate information about skills, experience, and references.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Respect termination conditions<\/strong>:\n<ul class=\"wp-block-list\">\n<li>In the event of early termination, notify the Client and the Agency in writing with reasonable notice.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p class=\"has-text-align-center has-ast-global-color-7-color has-ast-global-color-6-background-color has-text-color has-background has-link-color has-medium-font-size wp-elements-2132dd37dea787633951917621114946\"><strong>CONDITIONS ET\/OU CONTRAT DE PLACEMENT DE PERSONNEL DE MAISON<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-c8ac8b9fd8a527c37243b701534e110f\"><strong>1. OBJET DU CONTRAT<\/strong><\/p>\n\n\n\n<p>L\u2019Agence agit en tant que mandataire pour pr\u00e9senter des candidats (personnel de maison, garde d\u2019enfants de haut standing, etc.) au Client. <strong>L\u2019Agence n\u2019emploie aucun candidat<\/strong> : le Client embauche directement le Candidat sous son propre contrat, ou en tant qu\u2019ind\u00e9pendant si applicable.<br><strong>Le Client et le Candidat s\u2019engagent \u00e0 informer l\u2019Agence de toute embauche effective dans les deux mois suivant la pr\u00e9sentation.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-120d5393b8940897deaf0daf4f246ffc\"><strong>2. HONORAIRES ET MODALIT\u00c9S DE PAIEMENT<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Honoraires<\/strong> : Calcul\u00e9s en pourcentage du salaire annuel <strong>net<\/strong> du Candidat (voir bar\u00e8me ci-dessous).<\/li>\n\n\n\n<li><strong>Facturation<\/strong> :\n<ul class=\"wp-block-list\">\n<li>Un contrat = une facture. Pour un rota de deux nannies, deux contrats et deux factures seront \u00e9tablis.<\/li>\n\n\n\n<li>En cas de transformation d\u2019un contrat temporaire en permanent, un ajustement sera factur\u00e9 pour couvrir la diff\u00e9rence.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Paiement<\/strong> :\n<ul class=\"wp-block-list\">\n<li>Les honoraires doivent \u00eatre r\u00e9gl\u00e9s <strong>dans les 5 jours suivant la facturation<\/strong> et <strong>avant l\u2019entr\u00e9e en fonction du Candidat<\/strong>.<\/li>\n\n\n\n<li><strong>Tout retard de paiement peut entra\u00eener l\u2019annulation du placement<\/strong> et annule le droit \u00e0 un remplacement ou remboursement.<\/li>\n\n\n\n<li>Pour les placements temporaires, les honoraires sont dus d\u00e8s confirmation et signature du Client et du Candidat, m\u00eame si le d\u00e9but du contrat est diff\u00e9r\u00e9.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>R\u00e9servation payante<\/strong> (exclusivement pour les maternity nurses) :\n<ul class=\"wp-block-list\">\n<li>Si le d\u00e9lai d\u2019attente d\u00e9passe 4 semaines, une r\u00e9servation payante sera exig\u00e9e, couvrant :\n<ul class=\"wp-block-list\">\n<li>Une r\u00e9tribution pour le Candidat (\u00e0 n\u00e9gocier directement avec lui\/elle).<\/li>\n\n\n\n<li>Une r\u00e9tribution pour l\u2019Agence (pour bloquer le Candidat s\u00e9lectionn\u00e9).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Un Candidat bloqu\u00e9 par un contrat sign\u00e9 ne peut \u00eatre affect\u00e9 \u00e0 un autre Client<\/strong>, en cas de naissance anticip\u00e9e.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-75579541983721ad083e09a3bb54bb04\"><strong>3. FRAIS ET RESPONSABILIT\u00c9S<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00c0 la charge du Client<\/strong> :\n<ul class=\"wp-block-list\">\n<li>Frais de d\u00e9placement du Candidat (entretiens, prise de poste, retour).<\/li>\n\n\n\n<li>Logement et nourriture du Candidat pendant la mission.<\/li>\n\n\n\n<li>Toutes formalit\u00e9s administratives (immigration, contrat de travail, couverture m\u00e9dicale, etc.).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-3bf0f498a0c44d40563bd95fdfe04a94\"><strong>4. ANNULATION<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si le Client annule apr\u00e8s \u00e9mission de la facture, <strong>80% des honoraires restent dus<\/strong>.<\/li>\n\n\n\n<li>Si l\u2019annulation intervient <strong>moins de 4 semaines avant la prise de poste<\/strong>, la totalit\u00e9 de la facture reste due.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-f05db5d68abe17f5a6f6d08f85db568a\"><strong>5. P\u00c9RIODE D\u2019ESSAI ET REMPLACEMENT<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>P\u00e9riode d\u2019essai<\/strong> : 2 mois.<\/li>\n\n\n\n<li><strong>En cas de rupture pendant cette p\u00e9riode<\/strong> :\n<ul class=\"wp-block-list\">\n<li>L\u2019Agence recherche un rempla\u00e7ant (2 tentatives maximum).<\/li>\n\n\n\n<li><strong>Remboursement<\/strong> uniquement si :\n<ul class=\"wp-block-list\">\n<li>Le Candidat ne se pr\u00e9sente pas sans raison valable.<\/li>\n\n\n\n<li>L\u2019Agence ne trouve pas de rempla\u00e7ant dans les 2 mois suivant le d\u00e9sistement.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Pas de remboursement<\/strong> si :\n<ul class=\"wp-block-list\">\n<li>Le Client refuse un Candidat de substitution propos\u00e9 par l\u2019Agence.<\/li>\n\n\n\n<li>Les conditions r\u00e9elles d\u2019emploi ou de logement ne correspondent pas \u00e0 celles communiqu\u00e9es \u00e0 l\u2019Agence.<\/li>\n\n\n\n<li>La rupture est due \u00e0 une raison personnelle (maladie, d\u00e9c\u00e8s, accident, etc.).<\/li>\n\n\n\n<li>Le Client ne souhaite pas de remplacement.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Demande de remboursement<\/strong> : Doit \u00eatre adress\u00e9e par \u00e9crit \u00e0 l\u2019Agence <strong>dans les 5 jours<\/strong>, avec justification.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-6acc05c4c6395249b2ef32b9c1faa34b\"><strong>6. DISPOSITIONS G\u00c9N\u00c9RALES<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Entr\u00e9e en fonction<\/strong> : Soumise au paiement pr\u00e9alable des honoraires.<\/li>\n\n\n\n<li><strong>Formule \u00ab Open \u00bb<\/strong> : Option permettant au Client d\u2019acc\u00e9der \u00e0 un nombre illimit\u00e9 de candidats (voir forfait ci-dessous).<\/li>\n\n\n\n<li><strong>Confidentialit\u00e9<\/strong> : Toute information relative aux Candidats est strictement confidentielle.<\/li>\n\n\n\n<li><strong>Droit applicable<\/strong> : Le pr\u00e9sent contrat est r\u00e9gi par le droit fran\u00e7ais.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-6482d3336c2451275e4df2d61acd7bd2\"><strong>7. OBLIGATIONS DU CANDIDAT \u00e0 titre indicatif<\/strong><\/p>\n\n\n\n<p>Le Candidat s\u2019engage \u00e0 :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Respecter les termes du contrat de travail<\/strong> conclu avec le Client, notamment :<ol><li>Les horaires, t\u00e2ches et conditions de travail convenus.<\/li><\/ol>\n<ol class=\"wp-block-list\">\n<li>Les r\u00e8gles de confidentialit\u00e9 concernant la vie priv\u00e9e et les biens du Client.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><strong>Informer l\u2019Agence et le Client<\/strong> sans d\u00e9lai en cas de :<ol><li>Changement de situation (ex : indisponibilit\u00e9, probl\u00e8me de sant\u00e9, etc.).<\/li><\/ol>\n<ol class=\"wp-block-list\">\n<li>Difficult\u00e9 \u00e0 remplir ses obligations (ex : conditions de logement ou de travail non conformes \u00e0 ce qui \u00e9tait pr\u00e9vu).<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><strong>Se conformer aux lois en vigueur<\/strong> :<ol><li>Respecter les r\u00e9glementations locales (ex : droit du travail, immigration si applicable).<\/li><\/ol>\n<ol class=\"wp-block-list\">\n<li>Fournir tous les documents administratifs n\u00e9cessaires (ex : visa, contrat de travail, attestations).<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><strong>Assumer ses responsabilit\u00e9s professionnelles<\/strong> :<ol><li>Exercer ses fonctions avec diligence et professionnalisme.<\/li><\/ol>\n<ol class=\"wp-block-list\">\n<li>Ne pas divulguer d\u2019informations confidentielles sur le Client ou l\u2019Agence \u00e0 des tiers.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><strong>Participer aux entretiens et d\u00e9marches<\/strong> :<ol><li>Se rendre disponible pour les entretiens avec le Client et l\u2019Agence.<\/li><\/ol>\n<ol class=\"wp-block-list\">\n<li>Fournir des informations exactes sur ses comp\u00e9tences, exp\u00e9rience et r\u00e9f\u00e9rences.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li><strong>Respecter les conditions de r\u00e9siliation<\/strong> :\n<ol class=\"wp-block-list\">\n<li>En cas de rupture anticip\u00e9e du contrat, pr\u00e9venir le Client et l\u2019Agence <strong>par \u00e9crit<\/strong> avec un pr\u00e9avis raisonnable<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"<p>CONDITIONS AND\/OR CONTRACT FOR THE HOUSEHOLD STAFF PLACEMENT 1.
